Terms of Service

1. Agreement
These terms govern access to xZamin, operated by Sofenx. By creating an account, purchasing or requesting access, submitting marketplace content, or using an assessment, you agree to these terms and the policies linked below.
2. Accounts
Provide accurate information, protect your credentials, and notify us of suspected unauthorized access. You are responsible for activity performed through your account. You may not impersonate another person, evade restrictions, or interfere with platform security.
3. Student use
Assessment and course access is personal and may not be resold or shared. Students must not copy, distribute, scrape, or disclose protected questions, answers, lessons, videos, or downloads. Scores and course certificates reflect the rules and exact content version recorded by the providing organization and are not professional licenses unless explicitly stated.
4. Organization and seller responsibilities
Organizations are responsible for assessment and course accuracy, accessibility, grading, participant authority and consent, support for their content, and compliance with the Seller and Content Policy. Marketplace approval does not endorse or independently certify an assessment or course.
4A. Premium AI features
Premium AI output may be incomplete or inaccurate. Organizations must review generated questions, provide meaningful grading rubrics, monitor grading quality, and offer an appropriate human review or appeal path. AI scoring should not be the sole basis for a high-impact employment, education, licensing, or similarly consequential decision.
5. Orders, versions, access, and refunds
Prices and currencies appear before purchase. Course purchases grant access to the specific version displayed at checkout. Later versions may have different content and pricing and require a separate purchase, while progress and certificates for an earlier purchased version remain attached to that version. Access is granted only after verified payment or an approved free entitlement. Refund eligibility is governed by the Refund Policy.
6. Acceptable use
Do not upload unlawful, harmful, deceptive, infringing, discriminatory, or malicious content; compromise assessment integrity; access another user's information; reverse engineer security controls; send spam; or use the service in a way that harms users or infrastructure.
7. Suspension and marketplace action
We may reject, unpublish, restrict, or remove content and suspend accounts when reasonably necessary for safety, legal compliance, nonpayment, policy enforcement, fraud prevention, or service integrity. We will provide notice when practical.
8. Availability and disclaimers
We work to provide a reliable service but do not guarantee uninterrupted availability or that every assessment is error-free. To the extent permitted by applicable law, xZamin is provided on an “as available” basis and Sofenx is not responsible for independent decisions made solely from assessment results.
9. Liability and disputes
To the extent permitted by applicable law, Sofenx is not liable for indirect or consequential loss. Any mandatory consumer rights remain unaffected. The parties should first attempt to resolve disputes through support before pursuing other available remedies.
